Citizen relationships with law enforcement officers are notorious for causing problems for our clients. Furthermore, we will tell you that under no circumstances are you required to engage in an extensive conversation with a police officer. And, you definitely don’t have to let them search your car.

If they have enough probable cause, they will search your car regardless of your consent. However, if they don’t have probable cause, it’s our firm belief that you should never volunteer to allow a search of your car, your residence, or anything that you own. Instead, clearly and politely state your rights and this will often prevent unlawful searches, which can cause problems or lead to legal issues later.

In addition, you do have the right to remain silent and the right to an attorney. These rights are meant to protect you in dealing with law enforcement. If you are unsure of how to respond to a situation when approached by police, the best thing to do is to politely, but clearly, state that you do not consent to a search. Also, share that you would like to speak to a lawyer before answering any questions. Note, this approach will protect your legal rights and is likely to affect the outcome of any legal proceedings that may be initiated.
