In the state of Florida a felony is anything that is punishable by over one year of incarceration, so if it’s punishable by a year and a day, that’s what constitutes a felony. Typically for felonies you’re looking at the more serious criminal offenses. The robberies, the homicides, serious drug offenses, things of that nature.
Misdemeanors
Misdemeanors are the lower tier of criminal offenses. By definition they are things that are punishable by up to one year in incarceration. Things such as DUIs, simple batteries, some of the more minor drug-related offenses. Those are typically the misdemeanor type offenses.
Violations
Violations typically deal with probation which could be either felony or misdemeanor depending on the circumstances and violations are circumstances that are a little bit different in the sense that they’re dealt with directly by judges and they’re once someone has already been placed on a term of supervision as a result of a criminal charge. Probation is simply the agency that monitors the probationist.
