This is the first time I am in trouble in Florida. Will the prosecutor treat this charge like it is my first offense?

Prosecutors are always going to consider a defendant’s criminal history in working through a case, so yes, it is a situation where that is going to be one item of consideration. However, depending on the severity of the offense that you are currently charged with, it may not make a huge difference. If you have no prior record are charged with a homicide, that’s going to be treated very seriously no matter what your prior record or lack of, whereas if we’re talking a DUI or a minor drug offense, that factor is probably going to carry more weight.
