Expungement can be denied in Florida. In the end, simply because someone qualifies to expunge their record, does not mean that a judge automatically signs off on it. With that said, it is an extremely rare occurrence for an expungement to be denied by a judge. Certainly someone has a right to a hearing where they can present evidence in an attempt to convince the judge to expunge their record. Does it happen? Yes. Does it happen often? Absolutely not.
