What is a public defender?

When a person is arrested for any crime in the state of Florida and in fact throughout the United States, that person is guaranteed counsel whether or not they are able to pay for it. If a person cannot afford to employ an attorney for themselves, they are legally allowed to be provided with a public defender. A public defender is an independent practicing lawyer who is assigned by the court to represent the interests of their clients, in a court room.

This right to legal representation is enshrined in the American legal system under the Sixth Amendment of the Constitution. Which, this amendment guarantees the right to a fair trial. The public defender plays a very important role in the provision of adequate defense and protection of the rights of the accused regardless of their financial ability to hire a lawyer. Public defenders are formally educated attorneys who may be faced with numerous cases, which may pose some difficulties in terms of time and personnel. Nevertheless, public defenders do their best to defend their clients, fight for them, and do everything possible to get the most lenient outcome based on the existing legislation. This process is important in supporting the legal system since justice should be served to everyone regardless of their financial status to hire private lawyers.
