Someone can absolutely be stopped and/or arrested for DUI in Florida regardless of whether the vehicle is moving. I’ve actually handled a number of cases where my client was not even in the vehicle and has been charged with driving under the influence. It’s a very fact specific situation and there may be some very good legal defenses to that charge but for purposes of an arrest, absolutely. Someone can be arrested if a vehicle is not moving, even if the vehicle is not turned on.
