The loss of a driver’s license is a very big issue that is incredibly common in DUI prosecutions. In the state of Florida, someone can actually lose their license a number of ways in the course of a DUI. DUIs are two separate fights that get fought. Number one: There is a battle regarding someone’s administrative driver’s license through DMV. There are certain processes in place where we can try and attack the basis for that suspension. Additionally, even if we are able to win a DMV hearing, based on the statutory requirements in Florida, if someone is convicted of a DUI, there are court-ordered suspensions that go above and beyond what may happen with DMV. So, absolutely, there is a possibility that someone may lose their driver’s license in a number of different ways if they are prosecuted and ultimately convicted for a DUI.
